Effective from October 2026, the European Union has implemented new regulations pertaining to air passenger rights, primarily addressing baggage policies. The legislation, signed on 16 September 2026 and published shortly after, will take effect on 22 October 2026, and will be enforceable starting 23 October 2027.
This regulation guarantees travelers the right to carry a personal item into the aircraft cabin at no additional charge, as long as it complies with safety and security standards. The personal item must measure no more than 40 × 30 × 15 cm or fit under the seat in front of the passenger. It can be carried alongside another cabin bag, depending on the fare paid and airline baggage policies. Notably, the regulation does not specify a uniform weight limit or maximum combined dimensions for the additional hand luggage.
Furthermore, airlines and brokers will be required to display fares inclusive of hand baggage allowances before the booking process. This move aims to improve fare transparency and enable travelers to make more informed choices. The changes are part of the EU’s broader effort to strengthen passenger protections related to delays, cancellations, and mobility rights.
While the new rules will benefit flights departing from EU airports, their scope for journeys involving third countries or non-EU carriers depends on the departure airport and operating airline. For example, carriers from the United Kingdom must adhere to these rules when operating flights from EU airports to the UK, though passengers flying from the UK to the EU might not be covered due to Brexit implications.
Overall, this marks the most significant revision of EU air passenger rights in over two decades, promising greater clarity, fairness, and consumer protection across the European aviation sector.
